Terms of Service

By accessing or using Instant Description (the "Service"), available at instantdescription.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Instant Description.

Instant Description is an AI-powered software-as-a-service (SaaS) platform that generates video descriptions for multiple social media platforms. The Service uses artificial intelligence to transcribe uploaded video content and produce optimized descriptions based on user-defined brand profiles and platform requirements. The Service includes a web-based dashboard, generation history, brand profile management, and an enterprise API.

To use the Service, you must create an account. You must be at least 18 years of age to register. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been compromised.

Instant Description offers a $1 trial that provides full access to your chosen plan for 24 hours or 5 description generations, whichever occurs first. After the trial period ends, your subscription automatically continues at the regular price for your selected plan unless you cancel before the trial expires. Subscriptions are billed on a recurring monthly or annual basis through Stripe, our third-party payment processor. All prices are listed in US dollars. Your generation tokens reset at the beginning of each billing cycle and do not roll over to subsequent periods. Unused tokens expire at the end of each billing cycle. You may cancel your subscription at any time through the billing portal accessible from your account settings. Cancellation takes effect at the end of your current billing period, and you will retain access to the Service until that date. We do not provide refunds for partial billing periods.

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Specifically, you may not: - Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable. - Attempt to reverse-engineer, decompile, or disassemble any part of the Service. - Use automated scripts, bots, or other means to access the Service beyond the provided API. - Abuse the API or circumvent rate limits or usage restrictions. - Resell, redistribute, or sublicense access to the Service or its output without prior written permission from Instant Description. - Interfere with or disrupt the integrity or performance of the Service or its infrastructure. - Attempt to gain unauthorized access to the Service, other user accounts, or related systems.

You retain full ownership of all content you upload to the Service, including video files, brand profile rules, and any other materials you provide. You also retain full ownership of all descriptions and other output generated by the Service on your behalf. You may use generated descriptions for any lawful purpose without restriction. Instant Description retains ownership of the Service itself, including but not limited to the platform, source code, user interface, AI models, prompts, algorithms, documentation, and all associated intellectual property. Nothing in these Terms grants you any right to the underlying technology of the Service. Video files you upload are processed solely for the purpose of generating descriptions and are deleted immediately after processing. We do not store, retain, or use your video files for any other purpose.

Your privacy is important to us. Video files uploaded to the Service are ephemeral — they are processed in real time and deleted immediately after generation is complete. We do not retain, store, or archive your video files. Transcripts generated during processing and the resulting descriptions are stored as part of your generation history so you can access them later. You may delete any or all items from your history at any time. For complete details about how we collect, use, and protect your data, please refer to our Privacy Policy.

Enterprise plan subscribers may access the Service programmatically through our API. API usage draws from the same token pool as your dashboard usage — there is no separate API allocation. API access is subject to rate limits as documented in our API documentation. You are solely responsible for securing your API keys and ensuring they are not shared with unauthorized parties. Compromised API keys should be revoked immediately through your account settings. All other terms in this agreement apply equally to API usage. We reserve the right to suspend API access for accounts that violate rate limits or these Terms.

The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Instant Description does not guarantee the accuracy, completeness, or suitability of any AI-generated descriptions. You are solely responsible for reviewing and editing generated content before publishing or distributing it. To the maximum extent permitted by applicable law, Instant Description and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to Instant Description in the twelve (12) months preceding the claim.

You may cancel your account and terminate these Terms at any time by canceling your subscription through the billing portal and ceasing use of the Service. We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to the Service, other users, or Instant Description. Upon termination, your right to access and use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and cancel your account.
